Good Administration and the Council of Europe Law, Principles, and Effectiveness

Free Download Ulrich Stelkens, "Good Administration and the Council of : , Principles, and Effectiveness"
English | ISBN: 0198861532 | | 960 pages | | 18 MB
Good Administration and the Council of Europe: Law, Principles, and Effectiveness examines the existence and effectiveness of written and unwritten standards of good administration developed within the framework of the Council of Europe (CoE) and in the case law of the Court of Rights. These standards - called 'pan- European general principles of good administration' - cover the entire range of general organizational, procedural, and substantive legal institutions meant to ensure a democratically legitimized, open, and transparent administration respecting the rule of law. They are about the 'limiting function' of administrative law: its function to protect individuals from arbitrary power, to legitimize administrative action, and to combat corruption. This book analyses the sources and functions of the pan-European general principles of good administration and seeks to uncover how deeply they are rooted in the domestic legal systems of the CoE Member States. It comprises 28 reports dedicated to an in-depth exploration of the impact of these standards on the national legal systems of the Member States written by respective experts on these systems. It argues that the pan-European general principles of good administration lead to a certain harmonization of the legal orders of the Member States with regard to the limiting function of administrative law despite the many fundamental differences between their administrative and legal systems. It comes to the further conclusion that the pan-European general principles of good administration can be considered as a concretization of the founding values of the CoE and describes the 'administrative law obligations' a Member State entered into when joining the CoE.

Small nations are growing in prominence. In 1950, there were 22 sovereign states with a population below 18 million. Today there are 36 - not to mention many more stateless nations. What are the particular characteristics of the media in small nations? What do broadcasters and other media institutions in these countries face, how can these be overcome, and are there advantages to operating in a small national context? How are small nations represented on screen, and how do audiences in small nations engage with the media?Bringing together perspectives from across Europe, including case-studies on Catalonia, the Basque , Wales, Scotland, Iceland, Portugal, Slovenia and Macedonia, this collection answers these questions. At the same time, it provides readers with insights into broader issues of media , representation, national , transnationalism, audience reception and media research .With European media institutions and practitioners coming to terms with the changes brought about by digitisation and globalisation against a backdrop of uncertainty, this collection offers a timely contribution to debates about the media in Europe. Contributors include: Steve Blandford, John Newbigin, Sally Broughton Micova, Josep Àngel Guimerà, Ana Fernández Viso, Agnes Schindler, Dilys Jones, Trish Reid, Jacqui Cochrane, Anabela de Sousa Lopes and Merris Griffiths.

Since the beginning of the Community students of international politics and of international, resp. Constitutional , have been wondering what kind of animal it is, and will be, once has been completed. Whereas the EC Treaty of 1957 stressed the economic and envisioned a steady and dynamic progress towards a Single Market, it was conspicuously silent about the implications of integration and the new democratic order. What is needed, so the author argues in this powerful and original contribution to the debate on democratisation of the European Union, is a flexible system that supplements the European -making process with various direct democratic instruments such as the use of referenda. These would serve to increase the accountability of the politicians without demanding or requiring a resolution of the exact constitutional status of the Union.
